The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Tuesday, January 16, 2018, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on January 11, 2018, at 4:00 p.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.


Chairman Jason Shanks called the meeting to order.  Those present were as follows: Jack Godberson, Member; Nick Tucker, Assistant District Attorney (ADA); Susan Keen, Kay County Assessor; Steve Kelley, Kay County Sheriff; Dennis Bonewell, Emergency Management Director; Donna Parker, Oklahoma Court Services; Tracy Roberts, K&O Construction; David Hollingsworth, River Ridge Construction; Joe Gasper, Sunbelt Equipment; Kevin Lane, Rail Road Yard; Claude Williams, Taxpayers for Transparency; Tammy Reese, Secretary/Kay County Clerk.  Absent:  Paul Skidmore, Member (See sign in sheet).


Chairman Jason Shanks led the Flag Salute.


Motion was made by Godberson and seconded by Shanks approving regular meeting minutes of

January 8, 2018.  Motion carried:  Shanks, aye; Godberson, aye.


Donna Parker, Oklahoma Court Services presented the number of community service hour’s defendants are working and the projects they are involved in:  Ms. Parker reported New Community Service Clients-13; Regular Community Service Clients turned in for the month-50; Sanction Community Service hours completed-305; Total hours completed-901.8 and Community Service Offender Completions-10.  She told the completed events were they assisted with different tasks at the following places:  Salvation Army Kettle, Camp McFadden, My Favorite Things, Humane Society, Friendship Feast and Wheatheart Nutrition.  Ms. Parker named the upcoming events:  Community Care, Camp McFadden, Celebrate Recovery, My Favorite Things, Humane Society and Wheatheart Nutrition.


Quotes for Roof Top Unit for the Kay County Health Department in Ponca City:  Stolhand Heating and Air Conditioning-$8,607.00; Sooner Heating and Air, LLC-$6,690.00; Wards Air Conditioning-$6,519.00.  A letter (included with the quotes) from Lisa Cundiff, Business Manager at the Kay County Health Department stated because of customer service concerns she would like to go with Sooner Heating and Air, LLC.


Motion was made by Shanks and seconded by Godberson approving and accepting, upon recommendation of the Health Department, awarding the bid to Sooner Heating and Air, LLC.-$6,690.00 to install a new 4 ton roof top unit.  Motion carried:  Shanks, aye; Godberson, aye. 


Motion was made by Shanks and seconded by Godberson approving Agreements between the BOCC and the following to have remote terminal capabilities with the Assessor’s office.  DA Hermanson approved as to form:  Nga Wells; Blue Mark; RCB Bank.  Motion carried:  Shanks, aye; Godberson, aye. 


Road and Bridge Projects/Circuit Engineering District (CED) No.8 Road and Bridge Projects:

Commissioner Godberson stated crews are blading and hauling material to roads district wide, boom mowing on “R” Street, picking up trash, cleaning ditches and putting in steel pipes on Prentice Rd.


Commissioner Shanks noted crews started this week on beam work on Bridge 50.  He noted work is not finished east of town because of frozen conditions but will start again as soon as weather permits.  Crews are also working in the shop. 


Motion was made by Godberson and seconded by Shanks approving an Affidavit of Agreement by and between Steve Otto and County Commissioner Dist#1; both parties agree that Commissioner Dist#1 may enter on owner’s property to remove trees in the existing fence line.   Godberson noted his crews will remove trees on Coleman Rd.  Agreement approved as to form by DA Hermanson.  Motion carried:  Shanks, aye; Godberson, aye. 


Motion was made by Shanks and seconded by Godberson approving the following Kay County Monthly Reports for December 2017:  Election Board; Assessor; Health Department; County Clerk.  Motion carried:  Shanks, aye; Godberson, aye.


Motion was made by Godberson and seconded by Shanks approving the following Resolutions to Deposit Funds:   Res#17, 18-114, Highway Dist#1-$35,000.00/Dist#3-$177,500.00, Thunder Ranch Road Mtce. Agreement.  Motion carried:  Shanks, aye; Godberson, aye. 


New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.]  Sheriff Steve Kelley stated the Kay County Detention Center lost all power but through the generator they had light.


ADA Nick Tucker left the meeting to attend court.
