The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Tuesday, January 2, 2018, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma. Notice of the meeting was posted for public information on December 29, 2017, at 8:50 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.
Chairman Paul Skidmore called the meeting to order. Those present were as follows: Jason Shanks, Member; Jack Godberson, Member; Brian Hermanson, District Attorney (DA); Susan Keen, Kay County Assessor; Steve Kelley, Kay County Sheriff; Christy Kennedy, Kay County Treasurer; Dennis Bonewell, Emergency Management Director; Kristi Woolley, Oklahoma Juvenile Affairs; Donnie Head, CED Dist#8 Director; Jennifer Firgard, NODA; Claude Williams, Taxpayers for Transparency; Tammy Reese, Secretary/Kay County Clerk. Chairman Paul Skidmore led the Flag Salute.
Motion was made by Shanks and seconded by Godberson approving regular meeting minutes of
December 18, 2017. Motion carried: Godberson, aye; Shanks, aye; Skidmore, aye.
Motion was made by Godberson and seconded by Skidmore approving special meeting minutes of December 22, 2017. Motion carried: Godberson, aye; Shanks, abstained; Skidmore, aye.
Motion was made by Skidmore and seconded by Godberson approving and electing Jason Shanks as Chairman for BOCC 2018. Motion carried: Godberson, aye; Shanks, aye; Skidmore, aye.
Motion was made by Skidmore and seconded by Godberson approving Oklahoma Juvenile Affairs Claim for October 2017 in the amount of $4,044.39. Motion carried: Godberson, aye; Shanks, aye; Skidmore, aye.
No action was taken on NODA REAP Reimbursement Form.
Motion was made by Skidmore and seconded by Godberson approving Affidavit Certifying REAP Project Completion for Dale Township Fire Department. Motion carried: Godberson, aye; Shanks, aye; Skidmore, aye.
Motion was made by Skidmore and seconded by Godberson approving Resolution regarding Kay County Investment Policy authorizing and directing the Kay County Treasurer to invest County monies in her custody. Treasurer Kennedy told she has never used Credit Unions before but wanted to be able to take advantage (she explained). She also told this was the same Resolution approved at an earlier meeting date with the added language of using Credit Unions as an investment institution. Kennedy said statutorily it is okay but she would also visit with auditors. Motion carried: Godberson, aye; Shanks, aye; Skidmore, aye.
Motion was made by Godberson and seconded by Skidmore approving and establishing the IRS standard rate of mileage reimbursement for Kay County as 54.5 cents per mile to be effective January 1, 2018. Motion carried: Godberson, aye; Shanks, aye; Skidmore, aye.
Motion was made by Skidmore and seconded by Godberson approving Agreements between the BOCC and the following to have remote terminal capabilities with the Assessor’s office: Frontier Siding; Larry A. Heat/air situation in the courthouse: Chairman Shanks said he spoke with the company about the different temperature in the courthouse; some offices are extremely hot while other offices feel cold. Shanks said each office has their own thermostats so they can adjust the temperature but was told the thermostats do not work in freezing conditions. Shanks said he was told it takes the water a while to heat up and was told there is no way to adjust and regulate the temperature with the system that is in place.
Road and Bridge Projects/Circuit Engineering District (CED) No.8 Road and Bridge Projects:
Commissioner Godberson stated crews are blading and hauling material to roads district wide, boom mowing and cleaning ditches on South Avenue & Pecan Str., picked up trash on road sides, cleaned out ditches and fixed culvert pipes on LA Cann Rd. He told crews were preparing for bad weather by putting on snow plow and sand spreader.
Commissioner Shanks noted crews started a new project one and a half miles south of state line. He said the road is a creek bottom and county will change.
Commissioner Skidmore stated crews have been digging and hauling sand and shale to roads, loaded a sand spreader, took a truck to Tonkawa and Wichita for repairs. Donnie Head, CED#8, told Hubbard Rd. will be closing on January 8, 2018 and stated the detour would be “S” Street to Highland. Commissioner Skidmore noted crews have been posting signs around the area.
Motion was made by Godberson and seconded by Skidmore approving Claim from ODOT, Design Services for Erosion Control for Hubbard Rd. at Chikaskia River Overflow JP 32051(04), in the amount of $27,000.00, Dist#1. Donnie Head explained the BIA Contract has been closed. He said ODOT will pay BKL Engineering out of the CIRB account. Commissioner Shanks asked if ODOT would mitigate and redo so this can be put back on Dist#1 inventory. Donnie Head noted this is only for the Erosion Project and he reiterated the county will not be paying but rather ODOT would pay. Motion carried: Godberson, aye; Shanks, aye; Skidmore, aye.
Motion was made by Skidmore and seconded by Godberson approving to go out for bid on material and labor for Bridge 215A on “P” Street, Dist#3. Skidmore asked Donnie Head if this was on the 5 year plan. Head said it was not. He told Skidmore if he takes money from the 5 year plan to do this project it would delay his other projects on the plan and the 5 year plan will need to be amended. Skidmore said he wants to do this Bridge out of the 5 year plan. Motion carried: Godberson, aye; Shanks, aye; Skidmore, aye.
Motion was made by Skidmore and seconded by Godberson approving the following Resolution for Disposing of Equipment: Res#17, 18-109, Hwy. Dist#1, Motor Grader, to be sold at Elk City Auction. Motion carried: Godberson, aye; Shanks, aye; Skidmore, aye.
No action was taken on Resolutions to Deposit Funds (none presented).
