The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, November 6, 2017, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on November 3, 2017, at 8:50 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Paul Skidmore called the meeting to order.  Those present were as follows: Jason Shanks, Member; William J. McAllaster, District#1 First Deputy; Brian Hermanson, District Attorney (DA); Christy Kennedy, Kay County Treasurer; Dennis Bonewell, Emergency Management Director; Jack Godberson; Sharon Rowen, Ponca City News; Claude Williams, Taxpayers for Transparency; Tammy Reese, Secretary/Kay County Clerk.  (See sign in sheet).   

 

Chairman Paul Skidmore led the Flag Salute.

 

Motion was made by Shanks and seconded by McAllaster approving special meeting minutes of

October 16, 2017.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, abstained.

 

Motion was made by Shanks and seconded by McAllaster approving regular meeting minutes of

October 30, 2017.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by McAllaster approving to enter into a Public Building Authority special meeting (9:04 a.m.).  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by McAllaster approving to reconvene into the regular meeting of the BOCC (9:06 a.m.).  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by McAllaster approving Reimbursement for Election Board Secretary Salary for the month of October 2017.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving to go out for bid on Election Boards Annual Bid for Election Ballots for 2018.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Road and Bridge Projects/Circuit Engineering District (CED) No.8 Road and Bridge Projects:

First Deputy McAllaster stated crews are patching asphalt on Riverside and Ranch Drive and mowing.  He told Evans and Associates should being overlaying Rainbow and Enterprise Road today and will start on Rock Cliff Road later this week.

 

Commissioner Shanks noted crews are working on a box that collapsed on “R” Street and putting in pipe on half mile line on Ranch Drive, hauling rock and told for now they were caught up on blading.

 

Commissioner Skidmore stated crews ripped shale at shale pit and hauled shale to roads, hauling rock, mowing, repairing signs, grading and shaping.  Crews have been hauling shale and compacting it and laying rock on FEMA site on 13th and Brake Rd. to finish this last large project from May of 2015.  Skidmore told 44th Street will be shut down to repair and replace culvert north of Ferguson.  He said work continues with move from old warehouse to the new site.

 

Lease Purchase Agreement for Equipment and all documents/financial documents relating to this transaction, Caterpillar Motor Grader, Dist#2:  Commissioner Shanks said he spoke with Sherri Mount at Welch State Bank regarding the 60 month lease.  He said as DA Hermanson stated previously there is an option to go with a 12 year lease.  Shanks said he wanted to go with a 60 month lease with buy back of $165,000.  He said it is a cheaper interest rate to set up this way.

 

Motion was made by Shanks and seconded by McAllaster approving Lease Purchase Agreement for Equipment and all documents/financial documents relating to this transaction, Caterpillar Motor Grader, Dist#2 with a 60 month lease with buy back of $165,000.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Skidmore and seconded by Shanks approving not to award Bid#2017-35-Tractor, Dist#3 (opened in BOCC meeting on 10-30-17).  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving on the following Resolutions to Dispose of Equipment:  Res#17, 18-88, Court Clerk, mahogany desk transferred to Harper County Court Clerk.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving on the following Resolutions to Deposit Funds:  Res#17, 18-86, Highway Dist#2-$13,795.52, BIA Maintenance Agreement Project FY17-18; Res#17, 18-87, Highway Dist#2-$3,000.00, Public Service/Pipeline Crossing Line Installations.   Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.]  Dennis Bonewell discussed an invoice he received from Cintas; he said it is in regards to the Automatic Electronic Defibrillators (AED).  Bonewell stated Cintas has not been to the courthouse since we have had the AED’s to inspect or service.  He said he thought the county should refuse to pay this invoice on matters not ordered.

 

DA Hermanson and Chairman Skidmore stepped out of the meeting; Skidmore returned to the regular meeting and DA Hermanson left the meeting to attend court.
