The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, October 30, 2017, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on October 27, 2017, at 8:50 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Paul Skidmore called the meeting to order.  Those present were as follows: Jason Shanks, Member; William J. McAllaster, District#1 First Deputy; Brian Hermanson, District Attorney (DA); Susan Keen, Kay County Assessor; Kay County Sheriff Steve Kelley; Jack Godberson; Sharon Rowen, Ponca City News; Claude Williams, Taxpayers for Transparency; Tammy Reese, Secretary/Kay County Clerk.  (See sign in sheet).   

 

Chairman Paul Skidmore led the Flag Salute. 

 

Motion was made by Shanks and seconded by McAllaster approving regular meeting minutes of

October 23, 2017.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by McAllaster approving to enter into a Public Building Authority special meeting (9:01 a.m.).  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by McAllaster approving to reconvene into the regular meeting of the BOCC (9:16 a.m.).  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by McAllaster approving and authorizing Requisitioning Officers-Commissioners Dist#1, #2, #3; Receiving Agents-Jim Rugely, Chief/Mary Grace Lebeda, Treasurer for Ranch Drive Fire Department.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving Agreement by and between the BOCC and the following for remote terminal capabilities with the Assessor’s Office.  Buchanan Family Dentistry Blue Mark.  DA Hermanson approved as to form.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Road and Bridge Projects/Circuit Engineering District (CED) No.8 Road and Bridge Projects:

First Deputy McAllaster stated crews are finishing installing culverts on Enterprise Rd., grading, trimming trees and patching asphalt on Ranch Drive.

 

Commissioner Shanks noted crews are black top mowing for last time, blading and hauling rock.

 

Commissioner Skidmore stated crews ripped shale at shale pit and hauled shale to roads, hauling rock, mowing, repairing signs, grading, shaping roads and laying rock on 156th Street.  Crews have also been picking up trash and mattresses off the roads and hauling to dumpster. 

 

Motion was made by Shanks and seconded by McAllaster approving Report of Conference between Bridge Owner and Bridge Inspection Consultant/Bridge Inspection Invoice #436158 for professional services from September 14, 2017 to October 30, 2017 in the amount of $5,700.00.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Lease Purchase Agreement for Equipment and all documents/financial documents relating to this transaction, Caterpillar Motor Grader, Dist#2:  DA Hermanson said he reviewed all documents and approved to as form; he pointed out the 12 year 5 month lease. 

 

Motion was made by Shanks and seconded by McAllaster Tabling Lease Purchase Agreement for Equipment and all documents/financial documents relating to this transaction, Caterpillar Motor Grader, Dist#2.  Commissioner Shanks said he had additional questions with Warren Cat and Welch State Bank and wanted to further review this agreement before signing.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving the following Public Service/Pipeline Crossing Application:  Chilocco Windfarm, LLC-SE4/SE4 S26 T29N R2E ending SE4/SE4 S27 T29N R2E, Home Rd., Dist#2.  Commissioner Shanks told he received confirmation that PNE Wind USA, Inc. will pull ditches on home road before the transmission line goes in to avoid any future depth issues.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by McAllaster approving the following Public Service/Pipeline Crossing Application:  Kay Electric Cooperative, NW4/NW4 S31 T25N R2E ending SW4/NW4 S28 T25N R2E, Cowboy Hill Rd., Dist#1.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by McAllaster approving Officer’s Request of Supplemental Appropriations, to add funds to Assessor General Fund Maintenance & Operation-$360.00 (reimbursement from Treasurer for Assessor’s portion of AT&T U-verse bill).  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving on the following Resolutions to Dispose of Equipment:  Res#17, 18-85, Treasurer, (4) black leather chairs-transferring to Dist#3.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving on the following Resolutions to Deposit Funds:  Res#17, 18-84, Sheriff Service Fee-$8.31, refund on a child support case that is closed.   Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving Cash Fund Estimate of Needs and Request for Appropriations:  Treasurer’s Resale (Lapsed Balance 2016-17)-$23.10.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving the following Transfer of Appropriations:  Sheriff Overtime-$1,250.00 to Personal Service.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.]  DA Hermanson thanked the BOCC for his offices remodel; he said the offices are mostly back to normal and encouraged them to come and see.

 

DA Hermanson left the meeting to attend court.
