The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Tuesday, September 5, 2017, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on September 1, 2017, at 8:50 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Paul Skidmore called the meeting to order.  Those present were as follows: Jason Shanks, Member; William J. McAllaster, District#1 First Deputy; Brian Hermanson, District Attorney (DA); Christy Kennedy, Kay County Treasurer; Susan Keen, Kay County Assessor; Steve Kelley, Kay County Sheriff; Dennis Bonewell, Emergency Management; Sharon Rowen, Ponca City News; Claude Williams, Taxpayers for Transparency; Tammy Reese, Secretary/Kay County Clerk.  (See sign in sheet).   

 

Chairman Paul Skidmore led the Flag Salute. 

 

Motion was made by Shanks and seconded by McAllaster approving regular meeting minutes of

August 28, 2017.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

No action was taken on Requisitioning Officers, Receiving Agents and Inventory Clerks for the Kildare Rural Volunteer Fire Department (approved in BOCC meeting on 8-21-17). 

 

Motion was made by Shanks and seconded by McAllaster approving for the Kay County Sheriff’s office to apply for JAG Local Law Enforcement Grant (to be approved by BOCC Chairman with an electronic signature).  Sheriff Kelley said this is a $10,000 grant to be used to purchase a patrol vehicle.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving and authorizing Requisitioning Officers (RO), Receiving Agent (RA) and Inventory Clerks (IC) for Bear Creek-RO-BOCC/RA-Ken Brakey, Chief, Jan Heffner/IC-None; Dale Township-RO-BOCC/RA-Carole Stephens, Arien Seidel, Cory Goodno/IC-None and River Road-RO-BOCC/RA-Donnie Lane, Greg Williams/IC-None Volunteer Fire Departments.

 

Motion was made by Shanks and seconded by McAllaster approving designation of Holiday dates for calendar year 2018.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving notice of regular meeting dates for calendar year 2018 for the BOCC.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Road and Bridge Projects/Circuit Engineering District (CED) No.8 Road and Bridge Projects:

First Deputy McAllaster stated crews are mowing on Kildare and LA Cann Rd., patching asphalt on Enterprise Rd., replacing a culvert pipe on “T” Street and servicing equipment.

 

Commissioner Shanks noted crews were putting in blocks in a field so the ditch will not silk off LA Cann/Home Rd., mowing and blading.

 

Commissioner Skidmore stated crews ripped shale at shale pit, hauled shale and rock to roads, spraying and mowing roadways, moving supplies and equipment to new yard, finished dirt work on Dry Rd., worked on 92nd and Bender. 

 

Motion was made by Shanks and seconded by McAllaster approving Joint Instructions for Disbursement of Residual Funds from the Environmental Remedy Escrow, Enviro Clean Services-Invoice#ECE887-$12,380.21.  Chairman Skidmore noted there has been recent cleanup of the smelter waste.  DA Hermanson reminded BOCC the payment for the cleanup comes out of a fund that has been put aside for payment of the cleanup.  He told BOCC if there is money left in that account at the end of the term then it is to be divided 50/50 between the county and the plaintiff.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by McAllaster approving Affidavit of Well-Plugging Cost, Change of Operator, Operator’s Agreement to Plug Oil, Gas & Service Wells within the State of Oklahoma, Transfer of Operator & Letter of Credit to operate a gas well that is located on Dist#3 property at 319 N. 29th, furnish gas to Dist#3 and to obtain the legal right and ownership of the gas well.  Skidmore said he will need to get a surety bond in place and noted there hasn’t been any production since 2008.  Shanks asked exactly what does this mean.  DA Hermanson said basically he will get free gas from his own well.  Skidmore told the plugging of the well would cost $7,500; he said he has been in contact with the state and would like to get this free of charge.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Clerk Reese wanted clarification regarding paperwork; she said by reading the agenda item it appears there should be an affidavit and agreement, etc.  Chairman Skidmore said the paperwork is not ready.  Reese suggested they rescind the original motion and note what action they are taking.

 

Motion was made by Shanks and seconded by McAllaster rescinding motion approving Affidavit of Well-Plugging Cost, Change of Operator, Operator’s Agreement to Plug Oil, Gas & Service Wells within the State of Oklahoma, Transfer of Operator & Letter of Credit to operate a gas well that is located on Dist#3 property at 319 N. 29th, furnish gas to Dist#3 and to obtain the legal right and ownership of the gas well.

Motion was made by Shanks and seconded by McAllaster approving to proceed to move forward with documentation to follow on Affidavit of Well-Plugging Cost, Change of Operator, Operator’s Agreement to Plug Oil, Gas & Service Wells within the State of Oklahoma, Transfer of Operator & Letter of Credit to operate a gas well that is located on Dist#3 property at 319 N. 29th, furnish gas to Dist#3 and to obtain the legal right and ownership of the gas well.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by McAllaster approving the following Resolutions to Dispose of Equipment:  Res#17, 18-52, Court Clerk, Label Printer-returned to AOC/Framed Print-transferring to District Attorney office; Res#17, 18-54, Assessor, White 4-door 2003 Expedition, sold to salvage yard.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving the following Resolutions to Deposit Funds:  Res#17, 18-53, Hwy. D#3-$50.00, overpayment to Brown’s Tag Agency for tags; Res#17, 18-55, Public Building Authority PBA-KCD#3-$27,975.00; Res#17, 18-56, Hwy. Dist#3-$878.75, sale of scrap metals.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving Officer’s Request for Supplemental Appropriations for funds to be added to Treasurer General Fund Maintenance & Operations (M&O)-$360.00 (reimbursement of Assessor’s portion of AT&T U-verse bill).  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by McAllaster approving the following Transfer of Appropriations:  Hwy. Dist#2 ETR Bridge#57A-$1.02 to M&O; Hwy. Dist#3 M&O-$108.32 to Hwy. Dist#1 M&O; Hwy. Dist#1 Lease Purchase-$4,095.40 to Hwy. Dist#2.  Motion carried:  McAllaster, aye; Shanks, aye; Skidmore, aye.

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.]  Dennis Bonewell, Emergency Management, told the BOCC he would be in Alva to get re-certified in OK-First Weather Program.

 

DA Hermanson left the meeting to attend court.
