Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Tuesday, October 14, 2014, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on October 10, 2014, at 8:40 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Member Jason Shanks called the meeting to order.  Those present were as follows: Dee Schieber, Member David Wilkie, Assistant District Attorney (ADA); Carol Purdy, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Dennis Bonewell, Kay County Emergency Management Director; Everette Van Hoesen, Kay County Sheriff; Don Jones, Kay County Detention Center Director (KCDCD); Cheryl Howard, Kay County Election Board Secretary; Larry Klumpp, OSU Extension Agent; Ray Ball, Kaw Nation; Scott Cloud, Newkirk Herald Journal; Claude Williams, Taxpayers for Transparency; Tammy Reese, Secretary/Kay County Clerk.  Absent:  Chairman Tyson Rowe (See sign in sheet). 

 

Commissioner Jason Shanks led the Flag Salute.

 

Motion was made by Schieber and seconded by Shanks approving regular meeting minutes of October 6, 2014 and special meeting minutes of October 9, 2014.   Motion carried:  Schieber, aye; Shanks, aye.

 

Jail Director Report:  Don Jones, KCDCD, presented a report noting 198 as the current head count, 35 arrested and released over the weekend and 101 for the week, 15 inmates sentenced to Department of Corrections (DOC) 15 inmates sentenced to county time, six (6) contracts with BIA and Bridgeway and currently are holding two (2) inmates on writs (prison to court).  

 

Motion was made by Schieber and seconded by Shanks approving Application for Financial Assistance and Affidavit of Financial Inability to Pay.  Schieber said he knew the family and person speaking of was on social security.  Motion carried:  Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks approving Publication to be submitted regarding Kay County 2014-2015 Estimate of Needs and Financial Statement of the Fiscal Year 2013-2014.  Motion carried:  Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks approving Chairman to sign Agreement by and between the BOCC and Holmes and Yates Law, PLLC for remote terminal capabilities with the Assessor’s office.  Motion carried:  Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks rescinding original motion approving Chairman to sign Agreement by and between the BOCC and Holmes and Yates Law, PLLC for remote terminal capabilities with the Assessor’s office.  Motion carried:  Schieber, aye; Shanks, aye.

 

Motion was made by Schieber and seconded by Shanks approving Member Shanks to sign Agreement by and between the BOCC and Holmes and Yates Law, PLLC for remote terminal capabilities with the Assessor’s office.  Motion carried:  Schieber, aye; Shanks, aye.

 

No action was taken on going out for bid for uniform rental, laundry, mats, mops and rags. 

 

Motion was made by Schieber and seconded by Shanks noting the Management Representation Letter and Financial Statement and Independent Auditor’s for the FY Ended June 30, 2010, June 30, 2011 and June 30, 2012 have been received and filed.  Motion carried:  Schieber, aye; Shanks, aye.

 

Motion was made by Schieber and seconded by Shanks approving BOCC regular meeting dates for Calendar Year 2015.  Motion carried:  Schieber, aye; Shanks, aye.

Motion was made by Schieber and seconded by Shanks approving designating Holidays for Calendar Year 2015.  Motion carried:  Schieber, aye; Shanks, aye.

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge Projects:  Commissioner Schieber indicated the rain has slowed down road work.  He said there were a couple issues on Brake Road that have been resolved and noted it was too wet to grade roads.                 

 

Commissioner Shanks reported crews are looking at bad spots and low water crossings.  He said Longwood Road will be closed due to water being over the road and “W” Street between Doolin and Adobe Rd. closed from 9 a.m. to 3 p.m.  Shanks said crews are welding sheeting in the shop and waiting for the roads to dry out. 

 

Motion was made by Schieber and seconded by Shanks Tabling Contract Documents and Plans and Specifications for 2014 Bridge over Chilocco Creek, Dist#2 (waiting on approval by DA Hermanson).   Motion carried:  Schieber, aye; Shanks, aye.

 

Motion was made by Schieber and seconded by Shanks approving the following Kay County Monthly Reports for September 2014:  Assessor; Election Board; County Clerk; Treasurer; Public Health.   Motion carried:  Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks approving the following Resolutions to Deposit Funds:  Res#14, 15-69, Highway Dist#3-$1,266.00, sale of unprepared metal; Res#14, 15-70, Highway Dist#2-518.00, sale of unprepared metal.  Motion carried:  Schieber, aye; Shanks, aye.   

 

Motion was made by Schieber and seconded by Shanks approving the following Cash Fund Estimate of Needs & Request for Appropriations:  Highway Dist#3-$1,266.00; Highway Dist#2-$518.00; Treasurer’s Mortgage Certification-$605.00; Treasurer’s Mortgage Certification-$710.00; Public Building Authority-$1,408.84; Use Tax-$55,066.28; County Sales Tax-$356,041.87.  Motion carried:  Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks approving the following Transfer of Appropriations:  Highway Dist#1 Maintenance & Operations (M&O)-$30,000.00 to ETR Bridge Account; Highway Dist#1 Hartford/McFadden Road Project-$50,503.41 to Capital Outlay (Reimbursement); Sheriff’s Service Fee-$3,000.00 to Overtime.   Motion carried:  Schieber, aye; Shanks, aye.
