Kay County Courthouse

Newkirk, OK 

 

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, April 28, 2014, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on April 25, 2014, at 8:40 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Tyson Rowe called the meeting to order.  Those present were as follows: Dee Schieber, Member; Jason Shanks, Member; Brian Hermanson, District Attorney; Everette Van Hoesen, Kay County Sheriff; Carol Purdy, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Marilee Thornton, Kay County Court Clerk; Don Jones, Kay County Detention Center Director; Dennis Bonewell, Kay County Emergency Management (EM); Colt Donelson, Ponca City Tribe; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Secretary/Kay County Clerk.  (See sign in sheet). 

 

Chairman Tyson Rowe led the Flag Salute.

 

Motion was made by Schieber and seconded by Shanks approving regular meeting minutes of April 21, 2014.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Motion was made by Schieber and seconded by Shanks approving a contract for mowing county owned property.  Questions were directed to and answered by Christy Kennedy, Treasurer, regarding mowing, costs, bidding, etc.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Jail Director Report:  Don Jones, KCDCD, presented a report noting 231 as the current head count, 43 arrested and released over the weekend and 123 for the week, 38 inmates sentenced to Department of Corrections (DOC) DOC called for 12, nine (9) inmates sentenced to county time, six (6) contracts with BIA and Bridgeway and currently are holding four (4) inmates on writs (prison to court). 

 

Motion was made by Schieber and seconded by Shanks rejecting Bid#2014-27, Concrete Walk Ways & Chain Link Fence Sheriff Firearms Training Facility (bid opened in BOCC meeting 4-21-14) per Sheriff Van Hoesen’s request.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Motion was made by Shanks and seconded by Schieber approving rebidding of Concrete Walk Ways & Chain Link Fence for Sheriff’s Firearms Training Facility.  Sheriff Van Hoesen said he was changing the fence height to 6’ and correcting the concrete depth.  Schieber asked to include an option for 6’ and 4’ fence heights.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge Projects:  Commissioner Rowe said beams have been set on GRS abutment and the north bridge has been completed.  He mentioned his crews were cleaning up trees and blading roads.

 

Commissioner Schieber reported crews are hauling rock and blading roads.

 

Commissioner Shanks stated crews are blading, tore down Bridge 247 and taking head walls down and hauling off scrap iron.

 

Motion was made by Shanks and seconded by Schieber approving Reimbursement for Election Board Secretary Salary for April 2014.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks approving entering into a Product Lease Agreement with Meter Rental Agreement between Kay County Board of County Commissioners and Neopost USA Company.  DA Hermanson reviewed.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

No action was taken on the following Public Service/Pipeline Crossing Line Installations:  Southern Star Central Gas Pipeline, Inc., SW4/NW4 S7 T27N R2W ending SW4/SW4 S9 T27N R1W, Multiple road crossings, D#3. 

 

Motion was made by Schieber and seconded by Shanks approving the following Public Service/Pipeline Crossing Line Installations:  Select Energy Services, LLC, NW/NW S12 T25N R2W ending SE/SE S35 T25N R2W, 76th Street, D#3.   Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks approving Additional Homestead Reimbursement Claim for 2013 in the amount of $32,529.00.  Carol Purdy, Assessor, said we send these claims in each year for reimbursement but have not received reimbursement since 2001.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Motion was made by Shanks and seconded by Schieber noting the following Kay County March 2014 Monthly Reports:  Health Department; Sheriff; Court Clerk (Newkirk, Ponca City & Blackwell Offices.   Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Motion was made by Shanks and seconded by Schieber approving the following Resolutions to Dispose of Equipment:  Res#13, 14-199, Court Clerk, G.E. 1.0 CTP Microwave, junked.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks approving the following Resolutions to Deposit Funds:  Res#13, 14-200 Highway Dist#1-$322.00.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Motion was made by Shanks and seconded by Schieber to approve the following Cash Fund Estimate of Needs & Request for Appropriations:  County Sales Tax-$63,440.68; Sheriff’s Service Fee-$26,627.97; Highway Dist#1-$322.00; Highway Dist#3-$41.50; CBRI-$14.16;County Improvement-$.18; PBA-Pioneer Technology Center-$1.22; PBA-Tonkawa Schools-$.67.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Motion was made by Schieber and seconded by Shanks approving the following Transfer of Appropriations:   Highway Dist#3 Maintenance & Operations-$5,944.90 to Dist#1 Maintenance & Operations.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Unscheduled public appearances:  Brian Hermanson referred to comments made in last week’s meeting:  Mary Beth Ratliff, Fair Board Member, repeated she has not been receiving notices of the fair board meetings.  She said District Attorney Brian Hermanson assured her he would take care of the matter and he has not.  Ratliff spoke of a special meeting recently held where she did not receive notice of the meeting and asked if the meeting was valid if certain members did not receive notice.

 

Hermanson said he wanted it noted that he has indeed made contact at both requests to Jim Menzer, President of Kay County Free Fair Board regarding the above mentioned issues.  He answered Ratliff’s concern about the meeting being valid if all members were not notified stating the Executive Board was notified making the meetings valid and that Ratliff is a member of the Township not the Executive Board.
