Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, April 7, 2014, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on April 4, 2014, at 8:40 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Tyson Rowe called the meeting to order.  Those present were as follows: Dee Schieber, Member; Jason Shanks, Member; Brian Hermanson, District Attorney; Everette Van Hoesen, Kay County Sheriff; Mike Landis, Kay County Sheriff Department; Carol Purdy, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Don Jones, Kay County Detention Center Director; Harold Hughs, Kay County Detention Center (KCDC); Dennis Bonewell, Kay County Emergency Management (EM); Cheryl Howard, Kay County Election Board; Larry Klumpp, OSU Extension; Jerald Stone, Ponca City Citizen; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Secretary/Kay County Clerk.  (See sign in sheet). 

 

Chairman Tyson Rowe led the Flag Salute.

 

Motion was made by Schieber and seconded by Rowe approving regular meeting minutes of March 31, 2014.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, abstained.

 

Motion was made by Shanks and seconded by Rowe approving special meeting minutes of April 2, 2014.  Motion carried:  Rowe, aye; Schieber, abstained; Shanks, aye.

 

Jail Director Report:  Don Jones, KCDCD, presented a report noting 225 as the current head count, 54 arrested and released over the weekend and 116 for the week, 47 inmates sentenced to Department of Corrections (DOC), 14 inmates sentenced to county time and one (1) contract with BIA and Bridgeway.  Jones also presented a report listing the comparison between 2014 and 2013 and noted a 24 hour period high for the month of March as 254 up 78 inmates compared to March 2013.

 

Commissioner Schieber mentioned he had been told DOC may be taking DOC inmates from counties.  He commented, if they do, it is not right because of the pressure the state put on counties to build new jails.

 

Jones said that would take away funds and make it difficult to know how to budget for next fiscal year.

 

Motion was made by Schieber and seconded by Shanks approving going on bid for a Gun Range Fencing and Concrete, Sheriff Department.  Sheriff Van Hoesen told about the fencing and concrete needed for this facility and said Mike Landis would be the Range Officer.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Motion was made by Shanks and seconded by Schieber approving an Application for Beverage License for Otoe-Missouria Development Authority doing business as Lil Bit of Paradise 1.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks approving the following Agreements between BOCC and subscribers for remote terminal capabilities in the Assessor’s office:  City of Ponca City; Crumrine, Inc. Auctioneers; Sue Ellen Welch.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge Projects:  Commissioner Rowe said Evans and Associates would do the bridge tie-in, working on River Bridge on Braman Road, GSR abutment started, driving sheeting on 44th Street and demonstration on 44th still scheduled for April 22, 2014.

 

Commissioner Schieber reported crews are hauling rock, blading and cutting trees. 

 

Commissioner Shanks stated crews were blading and doing backfill on Bridge 237.  He noted trucks were checked for a recall.

 

Motion was made by Rowe and seconded by Schieber approving and accepting bids as follows on Bid#2014-22, Construction of Dist#3 Warehouse (bid opened in BOCC Meeting on 3-24-14):  BC Mechanical LLC, Alternate #5, heating and air (HVAC) for main building construction-$120,600.00; Hetrick Electric, LLC, Alternate #3, electrical for main building construction-$292,000.00; Koehn Building Systems, LLC, main building construction-$565,658.00.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks Tabling signing a Colonial Life Flex Supplemental Form to allow employees options concerning insurance under a flexible benefit plan.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Motion was made by Rowe and seconded by Schieber approving LPA Agreement and paperwork for Bridge over Birds Nest Creek Project, Dist#3.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.   

 

Motion was made by Schieber and seconded by Shanks approving Detention Services Agreement by and between Sac and Fox Nation and Board of County Commissioners at a cost of $21.11 per child per day.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Motion was made by Shanks and seconded by Schieber noting the following Kay County March 2014 Monthly Reports:  Treasurer.   Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Motion was made by Schieber and seconded by Shanks approving the following Resolutions to Dispose of Equipment:  Res#13, 14-193, Highway District#1, Goodroads Snow Plow, sold, Western Okla. County Surplus Auction.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Motion was made by Shanks and seconded by Schieber approving the following Resolutions to Deposit Funds:  Res#13, 14-191, Highway Dist#3-$750.00, Public Service/Pipeline Crossing Line Installation, D#3; Res#13, 14-192, Use Tax-$120,000.00, reimbursement for Hetrick Land Purchase from Highway, D#3.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye. 

 

Motion was made by Schieber and seconded by Shanks to approve the following Cash Fund Estimate of Needs & Request for Appropriations: Highway Dist#3-$750.00; Highway-$56.81 ($18.93-D#1; $18.94-D#2; $18.94-D#3); County Clerk Lien Fee-$1,709.00; Preservation Fee-$4,335.00; Treasurer’s Mortgage Certification-$450.00; Use Tax-$120,000.00; Public Buildings Authority-$1,408.84.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Motion was made by Shanks and seconded by Schieber approving the following Transfer of Appropriations:  County Assessor Travel-$900.00 to Personnel Services; Preservation Fee Capital Outlay-$50,000.00 to Maintenance & Operations.  Motion carried:  Rowe, aye; Schieber, aye; Shanks, aye.

 

Unscheduled public appearances:  Jerald Stone, Citizen, said he wanted to address the article that was in the Ponca City and Newkirk newspapers.  He stated more transparency was needed in county government.  Stone related he was pleased that Commissioner Austin and Treasurer Kennedy questioned Rowe regarding his spending on settlement funds.  He said he assumed these issues have been resolved since Rowe accepted large amounts on bids for construction and etc. on Bid#2014-22, Construction of Dist#3 Warehouse.   He said he did not want our county to be rated like Congress.  Stone added all elected officials are part of a governing body and we want to be highly rated.
