The Trustees of the Kay County Justice Facilities Authority (JFA) met in special session at 2:30 p.m., Friday, March 14, 2014, in the Sheriff’s training Room of the Kay County Detention Center (KCDC) in Newkirk, OK.  Notice of the special meeting was posted for public information on March 12, 2014, at the Kay County Detention Center front door and Sheriff’s training room door in Newkirk, OK.

 

Chairman Bruce Robinson called the special meeting to order.  Those present were as follows: Trustees – Steve Austin; Jim Greenhagen; Lowell LeFebvre; Jim Stieber; Everette Van Hoesen; Wes Young; Don Jones, Director KCDC; Harold Hughs, KCDC; Melissa Sprueill, KCDC; David Cummings, JFA Attorney; Brian Hermanson, District Attorney; Bill & Claude Williams, Taxpayers for Transparency; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  Absent:  Jim Stieber.   (See sign-in sheet).

 

Wes Young gave the opening prayer.

 

Motion was made by Everette Van Hoesen and seconded by Lowell LeFebvre approving regular meeting minutes of February 7 and March 7, 2014.  Motion carried:  Austin, aye; Greenhagen, aye; LeFebvre, aye; Robinson, aye; Van Hoesen, aye; Young, aye.

 

Jail Director Report:  Don Jones presented handouts with stats regarding number of inmates, restrictions on diets, medication, ages, etc.  He also gave a report comparing 2014 and 2013 and noting the increase of inmates.  Jones mentioned training for transport officers.

 

Maintenance and Operation (M&O) Reimbursement Request:  Jones provided a handout of unbudgeted M&O and repair items needing replaced.  Items demanding repair or replaced:  Indoor radio repeater, three television sets, four computer work stations, three unserviceable laptop computers, five desktop landline phone sets, four desktop monitors complete with software, staff uniforms, foot ware, jackets, four Tasers, batteries, and ten high security concealed door closers (Items 4 thru 9 on M&O Reimbursement Request page given to JFA Authority totaling $37,200.00)

 

Motion was made by Everette Van Hoesen and seconded by Wes Young approving the purchase of Items 4-9 on M&O Reimbursement Request page given to JFA Authority totaling $37,200.00. 

Motion carried:  Austin, aye; Greenhagen, aye; LeFebvre, aye; Robinson, aye; Van Hoesen, aye; Young, aye.

 

Mutual Assistance Agreement with Kay County Sheriff Office:  JFA Attorney David Cummings said this Mutual Assistance Agreement will be in place so the Detention Center may assist the Sheriff’s Office in emergency law enforcement situations at the Courthouse and immediate surrounding areas of Newkirk.  The Detention Center personnel assisting shall only be the transport officers, who shall be CLEET certified or in the process of seeking CLEET certification.  He noted this is statutorily allowable.  Cummings stated there is no end term in this agreement but can be terminated thirty (30) days prior to the effective date of such termination and may be terminated at anytime by either party.

 

Trustee LeFebvre asked if there were liability issues to be concerned about.

 

Cummings replied the JFA Authority was covered under the Governmental Tort Claim Act and that the Authority has insurance through Association of County Commissioners of Oklahoma (ACCO) that covers these situations.

 

Motion was made by Jimmy Greenhagen and seconded by Steve Austin approving Mutual Assistance Agreement with Kay County Sheriff Office.  Motion carried:  Austin, aye; Greenhagen, aye; LeFebvre, aye; Robinson, aye; Van Hoesen, aye; Young, aye.

 

Motion was made by Steve Austin and seconded by Wes Young approving the following purchase orders/requisitions submitted for payment:  David Cummings, JFA Attorney-$448.02, attorney and miscellaneous fees for February 2014; Bank of Oklahoma, Bond Trustee Fee-$1,400.00 annual fee.  Motion carried:  Austin, aye; Greenhagen, aye; LeFebvre, aye; Robinson, aye; Van Hoesen, aye; Young, aye.

 

There were no unscheduled public appearances made.
