The Trustees of the Kay County Justice Facilities Authority (JFA) met in regular session at 2:30 p.m., Friday, January 10, 2014, in the Sheriff’s training room of the Kay County Detention Center (KCDC) in Newkirk, OK.  Notice of the regular meeting was posted for public information on January 9th, 2014 at the Kay County Detention Center front door and Sheriff’s training room door in Newkirk, OK.

 

Chairman Bruce Robinson called the regular meeting to order.  Those present were as follows:  Trustees – Steve Austin; Jim Greenhagen; Lowell LeFebvre; Jim Stieber; Everette Van Hoesen; Wes Young; Harold Hughs, Acting Director KCDC; Melissa Sprueill, KCDC; Don Jones, Jail Consultant (2:33); Kevin Main, KCDC; David Cummings, KCDC Attorney; Bill Williams & Claude Williams, Taxpayers for Transparency; Scott Cloud, Newkirk Herald Journal; Sharon Rowan, Ponca City News; Holly Cline, Secretary/Deputy Kay County Clerk.  (See sign-in sheet).

 

Bruce Robinson gave the opening prayer.

 

Motion was made by Van Hoesen and seconded by LeFebvre to approve the minutes of the December 13, 2013 regular meeting and the December 26, 2013 special meeting.  Motion carried.  Austin, abstained; Greenhagen, aye; LeFebvre, aye; Robinson, aye; Stieber, aye; Van Hoesen, aye; Young, aye.

 

Jail Consultant Report:  Don Jones reported that projects including sidewalks, padded cells were progressing.

 

Jail Director Report:  Harold Hughs reported that the daily inmate population had increased 25% with the current inmate count being 236.  Hughs reported there are no major problems with the facility; however the north sidewalks have shifted above the curbing causing water to runoff toward the building.  Estimates are currently being obtained for repairs.  Installation of the padded cell is tentatively scheduled for the first week of February. Hughs commented that recommendations on the Fire Marshall Inspection report of January 9, 2014 had been corrected.

 

Hughs reported training continues for employees and a My Body, My Life seminar would be presented to the public on Jan 11, 2014 at the American Legion.

 

Hughs noted that sales tax continues to be above projections and the Finley and Cook audit came back without findings. 

 

Motion was made by Greenhagen and seconded by Austin to adjourn and convene into executive session (2:47 p.m.) to discuss the employment, hiring, appointment or promotion in regard to the position of Jail Director.  Motion carried. Austin, aye; Greenhagen, aye; LeFebvre, aye; Robinson, aye; Stieber, aye; Van Hoesen, aye; Young, aye.

 

Motion was made by Austin and seconded by Van Hoesen to reconvene into regular session of the Board of Trustees (4:17 p.m.).  Motion carried. Austin, aye; Greenhagen, aye; LeFebvre, aye; Robinson, aye; Stieber, aye; Van Hoesen, aye; Young, aye.

 

Motion was made by Van Hoesen and seconded by Austin to extend  an offer to Don Jones to serve as Jail Director at will for the consideration of $78,000 annually plus use of county vehicle and county benefits including other basic terms and conditions of the Jail Director position with a proposed start date of February 1, 2014.  Motion carried. Austin, aye; Greenhagen, aye; LeFebvre, aye; Robinson, aye; Stieber, aye; Van Hoesen, aye; Young, aye.

 

David Cummings stated his opinion letter is on file regarding the classification and use of Authority funds.  He noted that the 2/3 cent can be used for all purposes including maintenance & operation and construction.  Cummings also pointed out that more money cannot be borrowed.

 

Motion was made by Van Hoesen and seconded by Stieber to approve appropriating $610,000.00 for jail operations to fulfill the budget for FY2014.  Motion carried.  Austin, aye; Greenhagen, aye; LeFebvre, aye; Robinson, aye; Stieber, aye; Van Hoesen, aye; Young, aye.

 

Motion was made by Austin and seconded by Greenhagen to approve the following purchase orders for payment:  David Cummings, JFA Attorney, $2,480.00 attorney & misc. fees for December 2013; Don Jones, Jail Consultant, $900.00 consulting fees for December 2013.  Motion carried.  Austin, aye; Greenhagen, aye; LeFebvre, aye; Robinson, aye; Stieber, aye; Van Hoesen, aye; Young, aye.
