The Trustees of the Kay County Justice Facilities Authority (JFA) met in regular session at 2:30 p.m. Friday, November 9, 2012, in the Sheriff’s training Room of the Kay County Detention Center (KCDC) in Newkirk, OK.  Notice of the regular meeting was posted for public information on November 8, 2012, at the Kay County Detention Center front door and Sheriff’s training room door in Newkirk, OK.


Chairman Bruce Robinson called the regular meeting to order.  Those present were as follows: Trustees – Steve Austin; Carl Giddens; Lowell LeFebvre; Jim Stieber; Everette Van Hoesen; Wes Young; Don Jones, JFA Consultant; Jody Burd, Director KCDC; Melissa Sprueill, KCDC; Brian Hermanson, District Attorney; Christy Kennedy, Kay County Treasurer; Bill Williams & Claude Williams, Taxpayers for Transparency; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet).


Chairman Bruce Robinson gave the opening prayer.


Motion was made by Steve Austin and seconded by Wes Young approving the regular meeting minutes of October 12, 2012.  Motion carried: Austin, aye; Giddens, aye; LeFebvre, aye; Robinson, aye; Stieber, aye; Van Hoesen, abstained; Young, aye.


Jody Burd introduced Christy Kennedy, Kay County Treasurer, and told he asked her to come and explain in detail to the board the process that is followed with the county sales tax proceeds.


Treasurer Christy Kennedy began by saying the county is going through a three year audit and she presented handouts that she gave the auditors regarding the process of the County Sales Tax monies once received from the Oklahoma Tax Commission (OTC).  Kennedy listed out six steps on her handout and she explained each one to the JFA noting there is a cigarette tax received also.


Kennedy mentioned an additional $276,000 was received last July and she contacted the OTC and was told the monies were a correction from an entity that had not paid.  Later, she found that the OTC was incorrect in their findings and to make up for the over collection the county sales tax received for this month would be $79,000 plus whatever was collected for the cigarette tax.


Ms. Kennedy pointed out a Miscellaneous Receipt is created to put any interest made from County Sales Tax monies into the JFA Gross Revenue Fund.  She noted the auditors have issues with county funds not being on the general ledger.


Jail Consultant Report:  Don Jones, Consultant, said all jail staff is up-to-date on training.  He spoke regarding misconduct with inmates and mentioned an incident that happened in Garfield County.  Jones noted training will start over in January.


Jones talked about the County Jails and the Affordable Care Act/Obamacare and explained some of the changes, new laws, compliances and penalties regarding this act.  He noted National Association of Counties (NACo) has been putting out information concerning this matter.


Jail Director Report:  Jody Burd reported 180 for the inmate head count and noted this number was down, 39 in Department of Corrections and three sent this past week.  He noted new training and certification to begin January 1, 2013.  Burd said the sales tax receipts are staying up and looking positive for the future.


Don Jones mentioned the new federal detention performances for housing inmates and immigration standards.


Lowell LeFebvre asked about the video teleconferencing.


Austin said he received permission from the coop to put up a satellite or dish to bounce a signal from the courthouse to coop and coop to jail.


Burd said he sent out a scope to get specifications.


Motion was made by Jim Stieber and seconded by Lowell LeFebvre approving the KCJFA Annual Meeting Dates for 2013.  Motion carried.   Austin, aye; Giddens, aye; LeFebvre, aye; Robinson, aye; Stieber, aye; Van Hoesen, aye; Young, aye.


Motion was made by Wes Young and seconded by Everette Van Hoesen approving the following purchase orders/requisitions submitted for payment:  David Cummings, JFA Attorney, $820.35 attorney & Misc. fees for October 2012.; Don Jones, Jail Consultant, $900.00 consulting fees 10/1/2012 through 10/31/2012 (changed from amount of $1,000.00 as on Agenda); Bank of Oklahoma-$1,400.00 Bond Trustee Annual Fee, Invoice $5073432.   Motion carried: Austin, aye; Giddens, aye; LeFebvre, aye; Robinson, aye; Stieber, aye; Van Hoesen, aye; Young, aye.


Unscheduled public appearances:  Brian Hermanson commented during a jury trial the judge allowed the jurors to site scene and he thanked Jody Burd and his jail staff for their cooperation.


Burd noted inmates did not have anything ready for an art contest this month.
